         18               BE IT REMEMBERED THAT on Wednesday, the 29th

         19   day of February 2012, the above-entitled public comment

         20   hearing was held from 9:02 a.m. to 9:20 a.m., at the

         21   Offices of the Texas Lottery Commission, 611 East 6th

         22   Street, Austin, Texas  78701, before PETE WASSDORF,

          4                 MR. WASSDORF:  Good morning.  For the

          5   record, my name is Pete Wassdorf.  I am an Assistant

          6   General Counsel in the Legal Services Division.  On

          7   February 2, 2012, at a regularly called meeting of the

          8   Texas Lottery Commission, the Commission proposed a new

          9   rule at 16 TAC 401.320 for a new on-line game entitled

         10   "All or Nothing."  At that same meeting wherein the rule

         11   was proposed, the Commission ordered a public hearing to

         12   be held on Wednesday, February 29th, at 9:00 a.m., and

         13   notice of that hearing was given on the agency's website

         14   and it was also published in the Texas Register at

         15   Volume 37 Texas Register 1024.  The proposed rule was

         16   also published in the Texas Register at Volume 37, Texas

         17   Register, Page 833.  The purpose of the meeting is to

         18   take public comment on the proposed rule.  And I now

         19   call this meeting to order.

         20                 The Chair finds that there is no one in

         21   attendance at this meeting, other than staff, and no

         22   member of the public is present.  And we will,

         23   therefore, recess the meeting for 15 minutes to give any

         24   late arrivals an opportunity to get here, and we will

         25   reconvene at 9:20.
