18   COMMISSION held a Public Comment Hearing on Proposed
19   Administrative Rules on the 9TH of SEPTEMBER, 2005, at
20   10:00 a.m., before Brenda J. Wright, RPR, CSR in and
21   for the State of Texas, reported by machine shorthand,
22   at the Lottery Commission Headquarters, 611 East Sixth

 9                  MS. KIPLIN:  Good morning.  My name is
10   Kimberly Kiplin, General Counsel for the Texas Lottery
11   Commission.  With me today is Mr. Robert Tirloni, the
12   Products Manager in the Lottery Operations Division.
13                  I'm calling to order the rulemaking
14   comment hearing today on the Lotto Texas rule
15   amendments that were published in the September
16   2nd, 2005 edition of the Texas Register.
17                  Today is September 9th, 2005, and the
18   time is 10:10.  The notice for this hearing was -- was
19   to notice up the hearing for 10:00 a.m., today, here
20   at the Commission auditorium, at the Texas Lottery
21   headquarters at 611 East Sixth Street, Austin, Texas.
22   I've placed Witness Affirmation Forms and copies of
23   the Texas Lottery Commission's proposed amendments to
24   the rule as published in the Texas Register out in the
25   outer area for folks who want to testify and provide

 1   public comment, and the Witness Affirmation Form would
 2   need to be complete.
 3                  At this time let me ask if there is
 4   anybody in the audience who intends to make comment.
 5                  Okay.  I see no hands of anybody, no
 6   indication that anybody intends to make comment.
 7                  I'm going to go ahead and recess the
 8   hearing at this point, and we'll come back at 10:30
 9   just to make sure that if there is somebody who got
10   caught up in traffic or is having a hard time finding
11   a place to park, we make sure that we're able to go
12   ahead and get their comment on the record.  So at this
13   time, I'm going to go ahead and recess the rulemaking
14   comment hearing until 10:30.

16                  MS. KIPLIN:  Good morning.  My name is
17   Kimberly Kiplin.  We recessed this hearing this
18   morning until 10:30, and it was from 10:10, to try to
19   give people an opportunity to provide comment that may
20   have been caught up in traffic or have difficulty in
21   locating our offices.
22                  Let me just ask, is there anybody in
23   the audience today that does wish to provide public
24   comment?
25                  I see no indications of any interest to

 1   provide public comment.  In fact, just for the record
 2   there is nobody in the audience today other than an
 3   employee from the lottery.  So there is -- as far as I
 4   can tell, there are no citizens of the state of Texas
 5   or otherwise that want to provide comment.
 6                  At this time it is 10:34, and we will
 7   adjourn the hearing for today.  In doing so, we'll put
 8   on the record that there is still an opportunity to
 9   provide comment in a written format and there are
10   several different ways that comment can be provided in
11   that format.  We do have a feature on our agency's
12   website to where somebody who wishes can provide
13   public comment online.  Also, people can provide
14   comment by way of U.S. mail to me, or by fax.  And our
15   fax number is (512) 344-5189.  So at this time I'll go
16   ahead and adjourn the hearing.
