12                  BE IT REMEMBERED THAT on Friday, the
13   29th day of February 2008, the above-entitled public
14   comment hearing was held from 2:02 p.m. to 2:28 p.m.,
15   at the Offices of the Texas Lottery Commission, 611
16   East 6th Street, Austin, Texas  78701, before KIMBERLY
17   KIPLIN, GENERAL COUNSEL.  The following proceedings

 4                  MS. KIPLIN:  Good afternoon.  It's
 5   about two after 2:00 on Friday, February 29th.  I'm
 6   going to go ahead and call this hearing to order.
 7                  My name is Kimberly Kiplin.  I'm the
 8   General Counsel for the Texas Lottery Commission.  And
 9   with me today is Mr. Robert Tirloni who is the
10   Products Manager in the Lottery Operations Division.
11                  The purpose of the public hearing today
12   is to receive public comments regarding the proposed
13   repeal of rule 16 Texas Administrative Code, Section
14   401.312, relating to Texas Two Step on-line game and
15   to receive public comment regarding proposed new rule
16   16 Texas Administrative Code, Section 401.312,
17   relating to the Texas Two Step on-line game.
18                  The proposed rulemaking was published
19   in the February 1, 2008 publication of the Texas
20   Register.  The purpose today in the hearing is to
21   receive public comment.  In the audience there is no
22   one here to offer public comment.
23                  Just for the record, there are three
24   people that are actually in the room, and that is the
25   court reporter, Mr. Tirloni and myself.

 1                  So at this time we're going to take a
 2   recess, just in an abundance of caution, in case there
 3   are people who are trying to come into the building
 4   and park at the building.  We're going to go off the
 5   record, and we'll go back on the record at -- let's
 6   see.  It's 2:03 now.  We're go back on the record at
 7   2:25.

12   Once again, my name is Kimberly Kiplin, General
13   Counsel for the Lottery Commission.
14                  It is now 2:27, February 29, 2008.
15   This is a public comment hearing to receive public
16   comment on the proposed repeal of the Texas Two Step
17   rule and the proposed new rule, Texas Two Step new
18   rule.
19                  There is no one in the auditorium, save
20   and except myself and the court reporter.  So not
21   being presented with any witness affirmation forms
22   from anybody who wishes to provide public comment, the
23   hearing today was noticed for 2:00 p.m.  We took a
24   brief recess and went back on the record, and there is
25   still no one here.

 2   and adjourn the hearing for today.
