 4                  MS. WOELK:  Good morning.  My name is
 5   Sarah Woelk, Special Counsel for the Texas Lottery
 6   Commission.  With me today is Mr. Robert Tirloni, the
 7   Products Manager in the Lottery Operations Division.
 8                  I'm now calling to order a rulemaking
 9   comment hearing today on the proposed amendments to
10   various game rules in Chapter 401, Subchapter D of
11   Title 16 of the Texas Administrative Code.
12                  Today is October 18, 2007, and the time
13   is 10:01 a.m.  The notice for this hearing stated that
14   the hearing would be held at 10:00 a.m., today here in
15   the Commission auditorium at the Texas Lottery
16   Headquarters at 611 East Sixth Street in Austin,
17   Texas.
18                  The amendments at issue were published
19   in the October 5, 2007, edition of the Texas Register.
20   Specifically, the Lottery Commission has proposed to
21   amend Section 401.301, which sets out definitions;
22   Section 401.304, which sets out general rules
23   applicable to all on-line games; Section 401.305, the
24   Lotto Texas rule; Section 401.307, the Pick 3 rule;
25   Section 401.308, the Cash Five rule; Section 401.312,

 1   the Texas Two Step rule; Section 401.315, the Mega
 2   Millions rule; and Section 401.316, the Daily 4 rule.
 3                  We placed witness affirmation forms and
 4   copies of the Texas Lottery Commission's proposed
 5   amendments, as published in the Texas Register, in the
 6   entry area for people who wish to make comments.  And
 7   if you do wish to make comments, you must complete a
 8   witness affirmation form.
 9                  Is there anyone here who intends to
10   make comments on these proposed amendments?
11                  I see no indication that there is
12   anyone present who intends to make comments.  So I'm
13   going to recess the hearing until 10:15, in case there
14   is someone who is having trouble parking or trying to
15   find the building.  So right now we'll recess until
16   10:15.

22   hearing back to order.  I recessed this hearing until

 2                  Again, I see no indication that there
 3   is anyone who intends to make comment.  The only
 4   people present are the Court Reporter, Mr. Tirloni and
 5   myself.
 6                  I would like to include in the record
 7   that there is still an opportunity for people to
 8   provide comment in a written format by mail, facsimile
 9   transmission or e-mail, as indicated in the October 5,
10   2007, edition of the Texas Register.  The deadline for
11   providing written comment is Sunday, November 4, 2007.
12                  Because there is no one present at this
13   hearing who wants to provide comment, I am adjourning
14   this hearing now at 10:20 a.m.
