Sunset Advisory Commission Invites Public Input on the Texas Lottery Commission
The Sunset Advisory Commission is reviewing the mission and performance of the Texas Lottery Commission and welcomes public comments on whether the agency is still needed and ideas to improve its operations and services. The Texas Sunset Act requires the Sunset Commission to periodically review the Texas Lottery Commission and recommend whether to continue the agency and change state law to improve the agency’s efficiency and effectiveness. The Legislature ultimately will decide whether to continue the Texas Lottery Commission and adopt Sunset’s other statutory recommendations. The Sunset Commission also may adopt management directives for the Texas Lottery Commission that do not require statutory change.
The Sunset process has three stages. First, Sunset staff will evaluate the Texas Lottery Commission, seek public input, and issue a report recommending solutions to problems found. Second, the Sunset Commission will hold two public meetings: a hearing on the staff report and the agency, and a decision meeting to adopt recommendations to the Legislature based on the report and public comments. Third, the Legislature will convene in January 2025 and will consider Sunset’s statutory recommendations in a Sunset bill for the Texas Lottery Commission.

Please provide your comments by February 15, 2024 to ensure Sunset staff can fully consider your input while conducting their review. Comments submitted before the staff report is published in April 2024 will remain confidential.

The Sunset Review of the Texas Lottery Commission
The mission and performance of the Texas Lottery Commission has been reviewed by the Legislature as required under the Texas Sunset Act. The Act provides that the Sunset Advisory Commission, composed of legislators and public members, periodically evaluate a state agency to determine if the agency is still needed, and what improvements are needed to ensure that state funds are well spent. Based on the recommendations of the Sunset Advisory Commission, the Texas Legislature ultimately decides whether an agency continues to operate into the future.
The 83rd Legislature enacted House Bill 2197, the Texas Lottery Commission Sunset Legislation. Below is a link to the agency’s 2013 Sunset legislation. Currently, the Sunset Advisory Commission is scheduled to again review the Texas Lottery Commission during the 2024 – 2025 review cycle.
