Giveaway Rules
1. Promotion Overview
The Texas Lottery (TLC) will conduct a series of “Texas Lottery® Giveaway” promotion (contests) on its official Facebook page. The TLC will announce each Texas Lottery Giveaway promotion via Facebook post.
1.1. Each Texas Lottery Giveaway contest post will occur at Noon (12 p.m.) CT, where the TLC will ask Facebook users to respond to a question or engage in an activity in the comment section of the post.
1.2. For each Texas Lottery Giveaway, the first ten (10) eligible Facebook users to successfully answer that month’s question or participate in that month’s activity in the comment section of the Facebook post, and who then provide the information outlined in Section 5.2 of these rules, will receive one (1) Texas Lottery merchandise prize pack. No purchase is necessary to enter.
2. Definitions
2.1. TLC – Texas Lottery Commission.
2.2. Entrant – A Facebook user who answers that month’s question or participates in that month’s activity in the comment section of the TLC’s contest post.
2.3. Executive Director – the Executive Director of the TLC.
2.4. Deputy Executive Director – the Deputy Executive Director of the TLC.
2.5. Facebook – the features and services available from www.facebook.com.
2.6. TLC winner – An entrant that is selected as one (1) of the ten (10) persons who have won a Texas Lottery merchandise prize pack.
3. Eligibility to Enter
3.1. This promotion is open to Facebook users who meet the following eligibility requirements.
3.2. Persons prohibited by the Texas State Lottery Act from purchasing a lottery ticket for TLC games (including minors, TLC vendors and TLC employees and their immediate family members residing in the same household) are not permitted to submit entries and not eligible to win a prize in this promotion.
3.3. Each entrant is eligible to win only once during each promotional event.
3.4. All entries must be submitted from a location within the state of Texas.
3.5. The selected TLC winners must provide a valid Texas address. Only one (1) TLC winner per entry address.
3.6. Entrants must be eighteen (18) years of age or older to enter.
3.7. Each entrant may submit only one entry for consideration.
3.8. All decisions of the TLC regarding entries, determination and eligibility of TLC winners, or disqualification of entries, are within the sole discretion of the TLC and are final.
4. Prize Details
4.1. The TLC will award and fulfill ten (10) Texas Lottery prize packs within eight (8) weeks of each Texas Lottery Giveaway post.
5. How to Enter
5.1. Following the Texas Lottery Giveaway contest post on the official TLC Facebook page, Facebook users will answer that month’s question or participate in that month’s activity in the comment section of that post during the time period designated in the post for entry. Entries edited after submission will not be considered.
5.2. An entrant selected as a TLC winner must provide their full legal name, valid Texas address, phone number, email address, and other information as requested. Contact information will be used for communications regarding prizes only. By responding and providing this information to the TLC, the entrant hereby certifies under penalty of law that the entrant is eighteen (18) years of age or older and is not otherwise ineligible (as defined under Section 3), as required by the rules of this promotion.
5.3. Each entrant agrees that providing an entry into a promotional event constitutes an explicit agreement to abide by these rules governing the promotion and an explicit agreement to all disclaimers and releases under Section 9.
5.4. A promotional event will be conducted at the sole discretion of the TLC. The TLC does not guarantee that a promotional event will be conducted during any specific period, and the promotion may be discontinued at any time. Check the TLC Facebook page for more information on any upcoming promotional events.
6. Entry Requirements
6.1. All entries must conform to the TLC Social Media Guidelines and Comment Policy.
6.2. The TLC, at its sole discretion, may reject any entry that does not meet the entry requirements.
6.3. Once the month’s giveaway has closed, the TLC will send a message through Facebook Messenger to each TLC winner requesting the information set forth in Section 5.2 to verify eligibility.
7. Determination of TLC Winners
7.1. For each Texas Lottery Giveaway, the first ten (10) eligible entrants to successfully answer that month’s question or participate in that month’s activity within the comment section of the post, as determined by their order of appearance in the comment section during the designated time period, will win one (1) Texas Lottery merchandise prize pack.
7.2. A TLC winner will be notified of their selection via Facebook Messenger. Each TLC winner must complete the process set forth in Section 5.2 of these rules in order to receive the prize. The TLC winner has seven (7) calendar days to provide the requested information to the TLC.
7.3. In the event a TLC winner is ineligible, fails to complete the entry requirements, or otherwise is unable to accept the prize, the TLC will award the prize to the next eligible entrant.
7.4. All decisions of the TLC regarding entries, determination and eligibility of TLC winners, and disqualification of entries are within the sole discretion of the TLC and are final.
8. Prize Claims
8.1. After the TLC winners have been selected, the TLC will contact each winner using the contact information provided to make arrangements for awarding the prize.
8.2. TLC winners will be required to confirm eligibility prior to the award of a prize.
8.3. Once all TLC winners are verified, their names will be available by request at socialmedia@lottery.state.tx.us.
8.4. No cash equivalent of the prizes will be awarded, and prizes are not exchangeable, assignable or otherwise transferable. The TLC reserves the right to substitute a prize pack item with a similar item(s) of equivalent value.
8.5. The TLC shall not be responsible for any additional federal, state or local taxes that may become due if a TLC winner wins a prize.
9. Disclaimers and Release
9.1. The TLC does not guarantee that the promotion or any promotional event will be conducted during any specific time period, and they may be discontinued at any time.
9.2. Although information about TLC promotions may be accessed through www.facebook.com, TLC promotions are in no way sponsored, endorsed, administered by or associated with Facebook or Meta.
9.3. Information provided for this promotion will be collected by the TLC.
9.4. By submitting an entry for the promotion, each entrant grants the TLC permission to use their name and entry, photo or other submission in all TLC publications and advertising, including, but not limited to social media sites, without payment or other consideration or compensation. Entrants hereby irrevocably grant the TLC a perpetual license to use, edit, alter, copy, exhibit, publish and distribute their entry or other submission for purposes of publicizing the TLC, or for any other lawful purpose, and thereby waive any right to royalties or other compensation that may arise from the use of the entry photographs or other submissions. In addition, entrants waive the right to inspect or approve the finished product, including written or electronic copy, wherein their photo, video, essay, or other submission may appear.
9.5. Each entrant hereby releases the State of Texas, the Texas Lottery Commission, and all of their agents and employees from any and all liability or claims arising from participation in the promotion. Each entrant further agrees to hold harmless and release, and forever discharge the TLC and its commissioners, directors, officers, employees, agents, representatives and assigns, together with Facebook, from all claims, demands, and causes of action which entrants, their heirs, representatives, executors, administrators, or any other persons acting on an entrant’s behalf or on behalf of an entrant’s estate have or may have by reason of an entrant’s participation in the promotion and any promotional event.
9.6 TLC is not responsible for incomplete, lost, late, damaged, illegible, garbled, misdirected, or forged entries or for any technical problems, malfunctions of any telephone lines, computer systems, servers, providers, hardware/software, lost or unavailable network connections, information resources, or failed, incomplete, garbled or delayed computer transmissions or any combination thereof. TLC is not responsible for any damage to any individual’s computer or telephone system/software related to or resulting from participation or downloading any materials in this promotion and any promotional event.
9.7 PLAY RESPONSIBLY. Must be 18 or older to purchase a Texas Lottery ticket or enter a promotional second-chance drawing or other contest or promotion. The Texas Lottery supports Texas education and veterans. © 2022 Texas Lottery Commission.
10. Termination
10.1 The TLC Executive Director or Deputy Executive Director may, at any time and without advance notice, suspend or terminate this promotion, at which point no further entries will be accepted and no further prizes awarded in the promotion or the specific promotional event, as applicable.
