Texas Lottery® Lucky Dog/Cool Cat Photo Challenge Facebook Promotional Contest Rules – 2024
1. Promotion Overview
1.1. The Texas Lottery (TLC) will conduct a promotional contest on its official Facebook account to select two (2) TLC winners to win a custom photoshoot of their pet.
1.2. The two (2) eligible Entrants as verified by the TLC, on an eligible photo with the most likes in the comment section of the Facebook contest post will each receive a custom photoshoot of their pet provided by the TLC. No purchase is necessary to enter. All decisions of the TLC regarding entries, determination of winning answers, or disqualification of entries, are final.
2. Definitions
2.1. TLC – Texas Lottery Commission.
2.2. Eligible Photo – A photo that meets promotional contest requirements submitted by an Entrant who meets eligibility requirements. The specific contest requirements will be announced on the Facebook contest post on the date and time the contest begins.
2.3. Entrant – A Facebook user who submits a photo featuring the Entrant with their pet in the comment section of the contest post to enter the promotional contest.
2.4. Executive Director – the Executive Director of the TLC or his/her designee.
2.5. Facebook– the features and services available from www.facebook.com.
2.6. TLC winner – An entrant that is selected as one (1) of the two (2) winners to win a custom photoshoot of their pet provided by the TLC.
3. Eligibility to Enter
3.1. This promotion is open to Facebook users who meet the eligibility requirements described here.
3.2. Those who are not eligible to win this promotion include persons prohibited by the Texas State Lottery Act from purchasing a lottery ticket for TLC games (including minors, TLC vendors, and TLC employees and their immediate families) or those who fail to meet other entry requirements described in these rules or the Facebook contest post. Such individuals are not permitted to submit entries and are not eligible to win in this promotion.
3.3. Each entrant is eligible to win only once.
3.4. All entries must be submitted from a location within the state of Texas.
3.5. Selected TLC winners must provide a valid Texas address. Only one (1) winner per entry address.
3.6. Entrants must be eighteen (18) years of age or older to enter.
3.7. If there are not enough unique eligible entrants in the entry pool to award all of the TLC winners, there may be fewer than two (2) photoshoots awarded.
4. Prize Details
4.1 Each of the two (2) TLC winners will receive a custom photoshoot of their pet featured in the contest winning photo. The photoshoot will be conducted by TLC staff. The TLC winner(s) will receive digital photo files from their photoshoot sent to the e-mail address provided.
5. How to Enter
5.1. Details for the promotional contest photo requirements will be revealed in a Facebook post on the official TLC Facebook page Wednesday, March 20 at NOON CT and Wednesday, March 27 at NOON CT. Following the promotion announcement post, Facebook users will submit a photo featuring the Entrant with their pet in the comment section of that post during the designated time period for entry. Entries edited after submission will not be considered.
5.2. An entrant selected as a TLC winner in a promotional contest must provide their full legal name, valid Texas address, email address, and other information as requested. Contact information will be used for communications regarding prizes only. By responding and providing this information to the TLC, the entrant hereby certifies under penalty of law that the entrant is eighteen (18) years of age or older and is not otherwise ineligible (as defined under Section 3), as required by the rules of this promotion.
5.3. Each entrant agrees that providing an entry into a promotional contest constitutes an explicit agreement to abide by these rules governing the promotion and an explicit agreement to all disclaimers and releases under Section 9.
6. Entry Requirements
6.1. All entries must conform to the TLC Social Media Guidelines and Comment Policy. Please note that any photos that display images or text that could be interpreted as depicting violent acts, profanity, offensive language, offensive gesturing, nudity, alcohol, children under 18, or photos that otherwise violate the Texas Lottery’s Social Media Guidelines, will not be considered and immediately deleted.
6.2. The TLC, at its sole discretion, may reject any entry that does not meet the entry requirements; or otherwise reserves the right not to post or to remove a submitted photograph. If the TLC ultimately decides not to post a photograph on the TLC Facebook page, that photograph will be considered disqualified and the entrant who submitted the photograph is not entitled to notice or an explanation of the TLC’s decision.
6.3. All submitted photographs are subject to review and edit by the TLC.
6.4. Submitted photographs must be original, unpublished, and not copyrighted. The entrant must be the sole author and owner of his or her submitted photograph. Photographs depicting any identifiable intellectual property or branded material may be disqualified at the sole discretion of the TLC.
6.5. Submitted photographs must meet all other criteria for entry outlined in Section 6 in order to be eligible for consideration.
6.6. Once the promotion has ended, the TLC will send a message through Facebook Messenger to each TLC winner requesting the information that the TLC needs to verify eligibility. The TLC winner has seven (7) calendar days to submit information to the TLC to confirm their eligibility for a prize.
7. Determination of Winners
7.1. The first two (2) eligible entrants to successfully post a photo meeting the promotional contest requirements will be awarded a pet photo shoot provided by the TLC.
7.2. A TLC winner will be notified of their selection via Facebook Messenger. The TLC winner has seven (7) calendar days to submit required information to the TLC.
7.3. In the event a TLC winner is ineligible, fails to complete the entry requirements, or otherwise is unable to accept the prize, the TLC will award the prize to the next eligible entrant who submitted an eligible photo in the comments section as outlined in Section 6.
7.4. All decisions of the TLC regarding the determination of and eligibility of winners, and disqualification of entries are within the sole discretion of the TLC and are final.
8. Prize Claims
8.1. After TLC winners have been identified, the TLC will contact each winner using the contact information provided to make arrangements for awarding them their custom photoshoot.
8.2. TLC winners will be required to confirm eligibility prior to the award of a prize.
8.3. If the TLC is unable to contact a TLC winner using the contact information provided within seven (7) calendar days, or the winner fails to complete the process set forth in Sections 5.2 and 6.6 of these contest rules, the TLC may award the prize to the next eligible entrant as provided in Section 7.3 of these rules. After the TLC winner is confirmed, TLC will attempt to contact the winner within 3 business days of the planned photoshoot to confirm that arrangements made under 8.1. In the event the TLC winner does not respond to the TLC’s attempt by 5 p.m. CT on the last business day before the scheduled photoshoot, the prize will be forfeited, and the TLC will award the prize to the next eligible entrant who submitted an eligible photo in the comments section as outlined in Section 6.
8.4. Once all TLC winners are verified, their names will be available by request at socialmedia@lottery.state.tx.us.
8.5. No cash equivalent of the prizes will be awarded, and prizes are not exchangeable, assignable, or otherwise transferable.
8.6. The TLC shall not be responsible for any additional federal, state, or local taxes that may become due.
9. Disclaimers and Release
9.1. The TLC does not guarantee that the promotion or any promotional event will be conducted during any specific time period, and promotional contests or other promotional events may be discontinued at any time.
9.2. Although information about TLC promotions may be accessed through www.facebook.com, TLC promotions are in no way sponsored, endorsed, administered by, or associated with Facebook or Meta.
9.3. Information provided for this promotion will be collected by the TLC, not Facebook or Meta.
9.4. By submitting an entry for the promotion, each entrant grants the TLC permission to use their name and entry, photo or other submission in all TLC publications and advertising, including, but not limited to social media sites, without payment or other consideration or compensation. Entrants hereby irrevocably grant the TLC a perpetual license to use, edit, alter, copy, exhibit, publish and distribute their entry or other submission for purposes of publicizing the TLC or for any other lawful purpose, and thereby waive any right to royalties or other compensation that may arise from the use of the entry photographs or other submissions. In addition, entrants waive the right to inspect or approve the finished product, including written or electronic copy, wherein their photo, video, essay, or other submission may appear.
9.5. Each entrant hereby releases the State of Texas, the Texas Lottery Commission, and all of their agents and employees from any and all liability or claims arising from participation in the promotion. Each entrant further agrees to hold harmless and release, and forever discharge the TLC and its commissioners, directors, officers, employees, agents, representatives and assigns, together with Facebook, from all claims, demands, and causes of action which entrants, their heirs, representatives, executors, administrators, or any other persons acting on an entrant’s behalf or on behalf of an entrant’s estate have or may have by reason of an entrant’s participation in the promotion and any promotional event.
9.6. TLC is not responsible for incomplete, lost, late, damaged, illegible, garbled, misdirected, or forged entries or for any technical problems, malfunctions of any telephone lines, computer systems, servers, providers, hardware/software, lost or unavailable network connections, information resources, or failed, incomplete, garbled or delayed computer transmissions or any combination thereof. TLC is not responsible for any damage to any individual’s computer or telephone system/software related to or resulting from participation or downloading any materials in this promotion and any promotional event.
9.7. PLAY RESPONSIBLY. Must be 18 or older to purchase a Texas Lottery® ticket or to enter a promotional second-chance drawing or other promotional contest or event. The Texas Lottery supports Texas education and veterans. ©2024 Texas Lottery Commission.
10. Termination
10.1. The TLC Executive Director or designee may at any time and without advance notice, suspend or terminate this promotion, or any specific promotional event, at which point no further entries will be accepted and no further prizes awarded in the promotion or the specific promotional event, as applicable.
